Terms of Use

Welcome to the CritiqueIt.com web site (the “Site”). These Terms of Use (“Terms”) govern your use of the Site, its contents, and sets the standards of use of the CritiqueIt Service (“Service”) for Registered Account Members. The terms “CritiqueIt,” “we,” “us” and “our” refer to CritiqueIt, Inc.

By using this site, you (the “Member”) agree to the terms and conditions of use, the CritiqueIt PRIVACY POLICY, CritiqueIt COMMUNITY GUIDELINE, and you agree to receive required notices and to transact with us electronically. You can accept the Terms by clicking to accept the Terms where this option is made available to you by CritiqueIt in the user interface, or by actually using the Service.

You may not use the site if you do not accept the terms of use. If you do not agree to the Terms at any point in time, you must discontinue the registration process as provided below, discontinue your use of the Services, and, if you are already a Member, cancel your Account immediately.

1. Registration

You must register on this Site in order to use certain of the Site’s online Services and functions.

During registration, you may be required to provide contact information, consisting of an email address, username and password (your “login”) in order to create a user account (“Account’). You can select any username as you like, except that your username cannot be an impersonation of another person, a term that is the same or confusingly similar to a famous trademark, or a term that is offensive in any way. You may, but are not obligated to, use your own name. If you do use your own name, you consent to it being passed to others by use of certain of the functions of CritiqueIt and the Site. CritiqueIt reserves the right to reject or remove any username.

Your login may only be used by one person. A single login shared by multiple people is not permitted. You are responsible for maintaining the security of your account and password. CritiqueIt cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your Account. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

For certain of our functions, such as the purchase of Services, you may be required to provide your name, address and billing and credit card information (such information being “Your Data”), and maintain and promptly update Your Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or CritiqueIt has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CritiqueIt has the right to suspend or terminate your Account and refuse any and all current or future use of the Services, or any portion thereof.

2. Termination

Violation of any of the Terms contained herein will result in the termination of your Account. While CritiqueIt prohibits such conduct and content on the Service, you understand and agree that CritiqueIt cannot be responsible for the content posted on the Site and you nonetheless may be exposed to such materials.

No credits or refunds will be issued for any account that is canceled due to violation of the Terms contained herein, whether or not it is later proven that an actual violation occurred.

3. Backup and Restore policy

You agree to use the Site at your own risk. CritiqueIt is not responsible for files and/or data residing on your Account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on CritiqueIt servers.

  1. CritiqueIt does not maintain backup copies of Members’ files and/or data.
  2. CritiqueIt cannot guarantee the contents of the Site will never be deleted or corrupted.
  3. CritiqueIt always recommends that Members copy all Member content on the Site to a local computer and strongly suggest that Members make an additional copy (on tape, CD, multiple floppies, another desktop, or elsewhere) to ensure the availability of the files.

4. Age of Users

Children under the age of 13 may not use this Service and parents or legal guardians may not agree to these Terms of Use on their behalf. If we become aware that a child under 13 has provided or attempted to provide us with personal information, we will use our best efforts to remove the information permanently from our files.

If you are under the age of 18 but at least 13 years of age, you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If you are a parent or legal guardian agreeing to these Terms of Use for the benefit of a child between the ages of 13 and 18, be advised that you are fully responsible for his or her use of this Site, including all financial charges and legal liability that he or she may incur.

5. Non-Commercial Use

This Site and its contents are for your own personal non-commercial use only.

6. Additional Terms and Conditions for Software; EULAs

When you download and/or install and use CritiqueIt’s downloadable software, or register for or purchase the Site’s services, you will be required to agree to one or more End-User License Agreements (or “EULAs”) which may include additional terms. You will be bound by any EULA that you agree to.

7. CritiqueIt’s Privacy Statement

Your use of this Site signifies your continuing consent to the CritiqueIt’s Privacy Policy, which you can examine any time by clicking on the “Privacy Policy” link on the Site.

Personal information that you supply to CritiqueIt, and any information about your use of the Site that we obtain will be subject to the CritiqueIt Privacy Policy on this Site.

8. Changes to Terms

CritiqueIt reserves the right to update and change the Terms from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service.
